The Ethics and Anti-Corruption Commission (EACC) has been given fourteen days by an Eldoret Court to prosecute a case in which the Eldoret South MP Peris Simam and five other people have been accused of corruption.

The Anti-Corruption Court made the ruling after three of the accused went to the Eldoret High Court seeking to have the charges withdrawn against them citing infringement of their rights.

Lawyer Morris Buluma who is representing three Kenya Rural Roads Authority officials also charged alongside Simam told Principal Magistrate Ms Dolphina Alego of the Anti Corruption Court that charges before the court in relation to his clients were an infringement of their rights.

While giving the ruling Tuesday Ms Alego lashed out at EACC of delaying the start of the hearing of the case and ordered them to withdraw it if they could not start prosecuting the case.

The MP who is out on a bond of Sh1million is accused of being involved in the illegal award of a contract No U.G -2-27 to Kachur Holdings which she co-owns with her husband and yet it did not qualify for the tender.

She is also jointly accused of fraudulently acquiring Sh1.9million from KRRA being payment for work which was not satisfactorily done in her constituency.

The court further heard that the company was also issued with a payment certificate of Sh4.2million before construction was inspected by the concerned authority.

The KRRA officers were charged with failing to adhere to the tendering procedures and conspiracy to commit a crime contrary to the Anti – Corruption and Economic Crimes Act. The offences are said to have been committed between January 6 and April 11, 2010 in Eldoret.

The prosecution had asked for 21 days to seek directions from the Director of Public Prosecutions Keriako Tobiko after the three KRRA officials got orders from the High Court to have the hearing stopped citing violation of their constitutional rights.
