Hamisi Law Court finds man guilty for raping 8 year old girl

The Hamisi Law Courts charged Delvis Igadwa for defiling a class 2 pupil at Jeviriri village Gasianga sub-location, Banja location in Hamisi District.

The prosecution told the court that on the 8th day of June 2012, the accused willfully and unlawfully defiled a class 2 girl aged 8 years.

Recounting the painful ordeal before Hamisi Senior Principal Magistrate Julius Kipkosgei Ng’arang’ara, the girl said she was in company of three other girls when she met the accused as they were plucking guavas in a bush nearby their homestead, when the  accused pulled her a side into the bushes removed her clothes and did the heinous act.

“He removed my clothes and lay on top of me, I screamed and a lady came to my rescue,” she recalled.

Even though the lady rescued her, she warned her not to reveal to anyone what had happened lest she will be beaten.

“She told me not to tell anyone and if I dared to tell anyone she will beat me,” she told the court.

After the incidence, the girl went home and never said anything to her stepmother whom she lives with.

The following day while in school, the teachers noticed something unusual about the girl; she could not hold urine. This prompted the teachers to question her and that is when they learnt that she had been sexually assaulted and the teachers immediately informed the girl’s stepmother who in turn took the matter with the police.

The girl told the court that she felt a lot of pain when the man was penetrating her and she could not control urine after the act.

“I felt a lot of pain in my vagina and I could not even control urine afterwards,” she recalled.

The girl also told court that the accused has been issuing death threats to her and even at some point wanted to catch her but the police came to her rescue.

The court learnt that the said lady who rescued the victim of the assault is the accused grandmother.

The court found Delvis Igadwa guilty under section 11(1) of the Sexual Offences Act No. 3 of 2006 Laws of Kenya and remanded him at Kodiaga Prisons awaiting second hearing of the case on 1/08/2012.
